It’s International Day of People with Disability

Today, December 3rd is International Day of People with Disability. This worldwide day has now been running for 20 years, beginning as an internationally recognised day sanctioned by the United Nations. It is a day when disability should be in the forefront of the mind’s of policy-makers around the world. It is a rare day indeed.

But this year there is cause for some hope. For once it is not a blind optimism, far from it. A fully-funded National Disability Insurance Scheme is getting closer and closer. Five launch sites have been agreed to and funded jointly by state participants and the federal government.

At the same time though, the NDIS is far from a fait accompli. People with a disability, their carers and broader families, as well as disability services organisations need to keep the pressure on during the remaining years of this decade. We must do in order to ensure that government works towards allocating what will be upwards of $15 billion dollars a year towards the most important disability reform in the history of our nation.

International Day of People with Disability, as far as Australian domestic politics is concerned, is about much more than just ensuring that we have a well-funded and well-coordinated system for disability support.

This international day, according to the website is also about forging, across the global community, a broader “understanding” and acceptance of people with a disability. It is about how the broader population recognise the challenges that people with a disability face in both the poorest of countries and the wealthiest.

The day is also about other simple measures of a humane society. The International Day of People with Disability is also about trying to secure some of the most basic human rights.

Today is about making sure that we give people with a disability a level of dignity. Just as importantly, it is about pursuing and cementing the rights of the disabled and doing what we can as a society to guarantee the basic well-being of some of the most vulnerable people in the country.

Finally, the day is about integrating people with a disability into society, rather than leaving them at the margins with little support or understanding.

Believe it or not, Australia as a developed nation actually has a long way to go in the way that people with a disability are treated. Among OECD nations, Australia is failing our disabled people.

A report by PricewaterhouseCoopers from late last year made for some truly sad reading.

In that report it was found that 45% of Australian’s with a disability were living on or near the poverty line. Far from on its own being a damning statistic, that number places Australia 27th out of 27 developed nations in terms of being at risk of, or in poverty.

It does not get much better in terms of employment prospects for people with a disability in Australia.

It was found that Australia is ranked 21st out of 27 nations in relation to employment. Only 31% of disabled Australians were found by that report to be in active employment.

With Australia faring so poorly in providing for its disabled community, then one can only imagine how those in the poorest of nations are coping and today is as much about their plight as it is about our disabled people.

Today is a day when all governments, including our own, must pledge to do better, much better in the area of policy development for people with a disability.

In terms of what Australia can do, well, there are two things which are particularly urgent.

The first is to do significantly more in terms of access provisions.

With or without a National Disability Insurance Scheme, access will still be a major issue for people with a disability. Better access provisions will mean more economic participation can be achieved, in conjunction with all that the NDIS will provide. Better access would also mean increased participation in a range of activities that most in society take for granted.

The second most significant thing that needs to occur is a better understanding and importantly, a deeper acceptance of disability. This is particularly the case for businesses, but also government and society in a wider sense.

This means highlighting abilities and not impairments. Too often, negative perceptions of disability cloud the judgement of otherwise bright people and this simply has to stop.

If we focus too much on the NDIS and what it will bring, then we will be neglecting our duty to remind policy-makers that there is much more to be done in the area of policy for the disabled.

We do however appear to be on a somewhat promising path.

What Happened, What Does it Mean and What Next for Palestine?

The United Nations General Assembly has now voted emphatically in favour of granting the Palestinian delegation to the UN, non-member observer status. This is a symbolic victory, not a material one, for the territories seeking to one day be recognised with official statehood by the United Nations

So what happened? What does the vote mean? And what is next for Palestine?

Leading up to the vote, the Palestinian mission to the UN thought that they had secured about 132 votes of the 193 nation-state members of the General Assembly. This in itself would have been more than enough for a ballot victory, with ballots in the UNGA only requiring a majority ‘yes’ vote of 50% of the member countries, plus one.

The Palestinians received 138 votes in favour of them reaching the status of non-member observer state. This means that just over 70% of countries on the floor voted in favour of the motion.

Nine UN members voted against the motion. Most notably, this included the United States of America and Israel, both firm allies on the other side of the long-running Israel-Palestine conflict. The other states joining the USA and Israel in voting against the resolution were Canada, Czech Republic, Panama, Palau, The Marshall Islands, Nauru and Micronesia.

There were also forty-one abstentions which included large powers, including the United Kingdom and Germany. Australia also decided to abstain earlier this week.

Germany had been planning to vote against the motion. The Australian Government through Prime Minister Julia Gillard had also planned to vote ‘no’ to the idea of strengthening Palestinian observer status, but in the end, the caucus decided that Australia should instead abstain.

In the end, because of the nature of the General Assembly, as opposed to the Security Council, the vote was soundly won by the Palestinian Authority.

The next important question is: What does the new non-member observer state vote mean for Palestine in terms of what the position offers?

Well, it is a tokenistic position in terms of territory.

The vote does however grant Palestine an implied recognition of sovereign statehood, the equivalent stature to that of The Vatican as far as the United Nations is concerned.

The new-found recognition also means that the Palestinians are now able to become members of all UN member organisations. This includes the ability to petition the International Criminal Court for alleged war crimes.

The ability to join UN bodies and sign up to conventions and treaties are probably the two most significant aspects of the victory at the United Nations for the now implied state of Palestine.

Perhaps the most important question is: What comes next for Palestine?

In light of the UN vote, answering this question and charting a possible future for the peace process, perhaps becomes even more difficult than it was before the Palestinian victory at the UN General Assembly.

Israel and the United States of America are mightily annoyed. Officials from both countries are saying, as they did prior to Thursday’s vote, that it is a step backwards in terms of territorial negotiations and a lasting peace between Palestinians and Israelis.

Israel and the US are particularly annoyed that the decision now opens the door to proceedings of war crimes and broader crimes against humanity being levelled at the Israeli Government at the International Criminal Court.

The process required for charges to be brought by the Palestinians is prohibitive, even though they have flagged the possibility of referring individual Israelis to the ICC. Israel for one, along with the United States, does not recognise the jurisdiction of the court and would obviously not cooperate in handing over suspects.

Perhaps any intentions on the part of the Palestinian Authority to pursue Israel at the ICC should be immediately put off as an act of good faith. Proceedings could be instigated at a later stage, either if settlements in Palestinian territories continue, or the peace process becomes further intractable after a period of time.

Israel and the United States of America are also annoyed at the way in which the Palestinian territories have obtained the status of implicit statehood.

Really, both Israel and the USA should not be particularly concerned about Palestine now enjoying implied statehood. The change guarantees nothing in terms of actual territorial claims. That can only be determined by either a petition to the UN Security Council or by negotiations between Palestinian groups and the Israeli Government.

A direct petition to the Security Council by Palestinian representatives would never succeed. A similar petition last year by Mahmoud Abbas was never introduced because it was going to be blocked.

Official recognition of statehood at the Security Council would require 10 of the 15 member states to vote in favour of a resolution to create an official Palestinian nation-state. The USA, being a key and almost unwavering ally of Israel, even under President Barack Obama, have already indicated on previous occasions that they would use their veto power in the Security Council.

The best way forward is direct negotiations between Israel and Palestine, preferably with the United States of America involved as well as key powers in the Middle East. The key players have alluded to this, although their actions and words, particularly in the wake of the UN decision, seem to indicate little interest in strengthening negotiations over a two-state solution.

Negotiations too, have failed for decades. The recent increased tensions between Israel and Hamas, not just Thursday’s vote, have undoubtedly contributed to, at best, an even more protracted peace process.

The future of Israel-Palestine relations is at best tenuous. However, the present should be accepted for what it is and that is, in reality, a largely painless development.

If it’s not seen as such, then questions should rightly be asked about the actual intentions of Israel and the US, in terms of pursuing an enduring tw0-state solution.

Symbolism and Statehood are Two Different Things

The Australian Government was reportedly engaged in an especially robust party-room debate today. The Labor caucus was discussing the position to take on the United General Assembly vote set to take place in the coming days. This motion, if successful, would grant the Palestinian territories non-member observer status in the UN. Currently, the Palestinians have observer status.

After looking like the ALP caucus might vote ‘no’ to the motion, it soon emerged that the party-room, in the end, voted in favour of the Australian delegation abstaining from this highly non-controversial vote.

Not surprisingly, the United States of America and of course Israel, have indicated they will be voting against the motion in the UN General Assembly.

Unlike in the Security Council though, the US and Israelis voting against the measure will not matter. There is no veto power in the General Assembly and 132 of the 193 member countries have pledged recognition of Palestine as a state. Despite this, official recognition of statehood has been blocked in the United Nations Security Council.

During the ALP caucus discussions this morning, members of the left faction reportedly indicated that granting observer status would provide some assistance in promoting peace between Israel and the Palestinian territories.

This is an interesting concept. The position argues that by granting non-member state observer state status, the longstanding conflict would suddenly lurch closer to some form of mutually agreeable conclusion.

Clearly it will not. Hostilities on the part of Palestinian terror groups will not stop, at least until a broad solution involving Palestinian statehood is reached.

Terrorist acts on the part of some Palestinian factions would quite likely continue, even in the event of a negotiated peace between authorities on both sides of the conflict. They would however be more isolated and not necessarily linked with representative political organisations.

However, such heinous crimes would still not be tolerable, no matter how infrequent. The point must be made too, that both sides are and have been in the wrong on this issue, albeit in different ways.

The reluctance on the part of the Israelis and the USA to recognise Palestine as an official state would also continue, virtually leaving the situation at the status quo. Non-member state observer status will be a symbolic act.

Granting non-member state observer status is however one that the Israeli government should not be scared of. But they are and they will probably be annoyed. They need to realise, however, that there is a clear difference between a vote for non-member state observer status and a peaceful two-state solution. The latter should be negotiated outside the United Nations.

It is curious that Australia will abstain from the vote. Abstention, to some, gives the appearance that Australia is basically hedging their bets.

Abstaining from the vote will likely be seen by the representatives of the Palestinian territories as a vote against their motion, since the Australian Government does not feel a compulsion to vote for what is ostensibly a sensible concept.

This week’s vote is not about statehood and probably will not provide much of a catalyst toward the Palestinian territories becoming a recognised state.

So why such a fuss?

Small Cause for Hope in a Grim Situation

Israel and Hamas have agreed to the terms of a ceasefire after over a week of rocket attacks perpetrated by both sides of the conflict. Hamas had been rocketing Israel and in return the Israelis sent missiles hurtling into Palestinian territories. Approximately 150 people died in the conflict, the vast majority being Palestinians.

Perhaps surprising to some, Egypt, now controlled by an Islamist government was crucial in negotiating the terms of a ceasefire agreement with Palestinian group, Hamas.

There are four elements of the agreement brokered between Israel and Hamas.

First, it calls on Israel to halt land, sea and air assaults and incursions in the Gaza Strip. This includes, as part of the deal, Israel agreeing not to target individuals in Palestinian territories.

The first part of the ceasefire agreement would appear likely to hold now, with the world’s attention, for at least as long as the Palestinians stop firing rockets into Israel.

Although Israeli incursions into Palestinian territories are a major factor in the ongoing tensions between Israel and Palestinians, this part too seems likely to hold as long as rockets from Palestinian territories are not fired.

The second condition of the ceasefire involves all Palestinian factions. Under the ceasefire, they must not target Israel in any way, be it from the Gaza Strip or the border regions.

The second condition, largely the reverse of the first one, is less likely to hold. There are multiple groups on the Palestinian side with factions that will prove very difficult to control and there is the distinct possibility that possible militant attacks from outside groups might easily be mistaken as originating from Palestinian terrorists.

Ceasefires in general are tenuous and, as such, it will probably be just a matter of time before both the first and second elements of the accord are broken.

The third and perhaps most significant element of the ceasefire is an agreement to open all border crossings. This includes an understanding that the movement of both people and goods must be facilitated and must in all cases be free. Again, this involves an understanding that border residents not be targeted, this time when attempting border crossings. However, this clause of the ceasefire is not immediate. After 24 hours of the ceasefire have passed, this tenet will come into effect.

The third part of the pact is very important. However, if the ceasefire does not last more than a day, then Israel will again close her borders and the free movement of people will cease again.

If the ceasefire does hold and that is very unlikely, then Israel stopping incursions and allowing border crossings will be seen quite favourably by most factions on the Palestinian side.

The final clause is potentially important too in terms of long-term considerations in that it opens up the possibility of further dialogue. The fourth part of the ceasefire equation allows for the negotiation of further issues involved in the dispute between Israel and Palestine.

The fourth part of the ceasefire does provide the opportunity for ongoing dialogue which might lead to discussion of the important and substantive issues in the medium to long-term. However getting to that point would almost certainly hinge upon a well-maintained ceasefire between Israel and Hamas at the very least.

There are a number of small positives but it would appear that they are largely overshadowed by the likelihood of an enduring ceasefire being minimal at best.

The part that Egypt played is interesting and provides hope, but the assistance provided to Hamas from Iran would give pause for concern, over and above the usual fragility of ceasefire agreements.

Having so many disparate groups on the Palestinian side is also a challenge in terms of maintaining order in Israel and the Palestinian territories on any given day.

Add to that the realisation that the conflict involves far more than just territorial considerations, but also regional issues and extremism, and seeking a lasting peace becomes an even more challenging task.

This Is the Political Story of a Hurricane

Post Tropical Storm Sandy has now vanished from the skies above the United States of America. In its wake it has left at least 90 dead with the final death toll likely to be higher than that. The hurricane has also resulted in billions of dollars damage to cities along the east coast of the USA. Now that the storm has passed, attention first and foremost has turned to the recovery with FEMA and the US President hitting the ground running. The US President has toured areas hit by the natural disaster and FEMA have commenced their post-disaster efforts.

Despite the fact that a tragedy has just transpired, the US election, which has seen an intriguing campaign so far, is still going ahead. Polling day is now less than a week away and after a brief ceasefire, electoral hostilities have resumed in key swing states across the country.

Inevitably, thought has turned to the effects that the hurricane has had on the campaign and might have on the outcome on election day. Would the storm help or hinder Barack Obama and end Mitt Romney’s chances or would it end Barack Obama’s hopes for re-election? Or would the storm have left the electoral equation relatively unchanged?

It would appear that there are two main scenarios which could play out as a result of Hurricane Sandy. But there is also the possibility of a third effect brought on by the tropical storm.

The first is the really obvious one. This is the one that seems to be in the mind’s and on the lip’s of many political commentators. That is that the devastation gives President Obama a chance to appear presidential, an interesting conclusion given that President is exactly what Barack Obama currently is.

This theory holds that the President, through responding to the crisis, will gain electoral momentum thanks to the horrific events which have killed so many, not just in the USA, but also throughout parts of the Caribbean.

Whether or not this theory holds any credibility is largely down to the states involved in the hurricane, with the broader populace probably not as concerned about Barack Obama appearing presidential as a result of something that does not affect them. Most of the directly hit states are well and truly in the bag for either side, save for Virginia and North Carolina.

The theory of looking presidential with strong and swift actions after a tragic event could also be applied to Mitt Romney. It is somewhat arguable that appearing presidential as the challenger could have more of a benefit than the incumbent coming across to voters in the same way.

Governor Romney quickly hit the bellwether state of Ohio for what was termed a ‘ hurricane relief event’. At this outing, Obama’s adversary organised for donations of food and other goods to be sent to storm-hit areas of the country.

This event and others like it as well as Romney’s responses regarding the awful events of earlier this week mean that he could also appear presidential to voters. Again, whether this matters is debatable, though with Governor Romney enjoying most of the electoral momentum, small gains could make a difference.

The other theory is that Sandy might be responsible for halting the momentum of the campaign.

This theory offers more negative consequences for the President than it does for Mitt Romney. Effectively, if this was the case it would mean that two days were removed from Barack Obama’s last week and a bit of the campaign. This means two less days campaigning for votes.

The final effect is mostly a positive for the sitting President, at least for the period of time it was in play.

It is within the realms of reason, even self-evident, that the hurricane provided a distraction for up to almost a week from the real issue that Americans will be voting on when Tuesday next week rolls around. For that time, news of the economy and debate about it would have played second fiddle to the approaching winds and rain.

Whether or not two days of almost zero talk about the has resulted in a change of the complexion of the campaign seems unlikely. The storm is over now too and the focus of the campaign has largely returned to domestic issues.

It would appear that any benefit for either Republicans or Democrats, President Obama or Mitt Romney, derived from the storm that hit the east coast, is small or even negligible. Stranger things have happened though. Who would have thought that a debate would result in quite a dramatic shift in voter intentions?

With less than a week to go in a tough contest, the result is still anyone’s, even with a hurricane thrown into the equation.

How to Spend $25 Million and Not Gain Much

Early tomorrow morning foreign policy wonks will be sitting in front of their televisions, the radio or madly refreshing the pages of news websites as they wait to see whether or not Australia has secured a temporary two-year spot on the United Nations Security Council. Two of our senior politicians, the Prime Minister and the Foreign Minister have ventured to the UN in New York in recent weeks, scrambling to attract the vote of countries not already locked in behind either Luxembourg or Finland, our competitors for the two available places.

Domestically, there is not bipartisan support for the UN Security Council campaign. Former Prime Minister Kevin Rudd launched the bid and that has been carried through by his replacement, Julia Gillard. The Labor Party have plunged about $25 million into this electoral gamble, with relatively good odds. The Opposition on the other hand are against the bid labelling it wasteful and pointless, preferring a regional focus to foreign policy.

With the vote taking place in less than a day, what exactly would be gained by a victory in the vote at the United Nations tomorrow? What will change?

The obvious and most simple and straightforward answer is a seat on the Security Council, the most significant body within the UN structure. We would be able to say things, nice things and bad things about different peace and security issues at the table rather than from the periphery. Would that not be wonderful for us, to be able to chest-beat at the most significant international forum for a couple of years? How wonderful for us.

Then there’s the not insignificant factor of being able to engage with other nations at the UN Security Council. Well, that’s just brilliant. For two years we can have greater engagement with the world, a closer proximity that we couldn’t possibly have had without the UN. How our region would love it if we were to focus a little less on it for two years in favour of pretending we have the ability to save the world.

Australia would not just be able to praise or prod other nations with our words, or enjoy a temporary closeness with more of the world, oh no, we would even be able to vote despite the fact that we would only be there and able to vote for two years.

That vote would actually mean something too, sometimes. Sometimes our vote might align with the US, the UK, China, France and Russia. Well, most of the time we are probably going to be saying the same thing as the United States of America and United Kingdom, that’s the way the cookie crumbles, you know, allies and all that diplomatic and defence type stuff.

In other cases our votes might not align with the five permanent members of the Security Council and is that not the best eventuality ever? If just one of those 5 countries decides they do not like a resolution, they are more than welcome to tell a numeric majority of members where to go. That wonderful veto power has the ability to stifle action in some of the most grave matters the Security Council deals with. By doing so, it would render our voice useless.

So there you go. Basically we get to gamble away $25 million, win or lose. That’s great odds as far as gambling goes, for little actual gain if we win. For that price we have the chance to be great pretenders for two years. Twenty-five million dollars will buy us the right to have our middle-power thoughts disregarded from time to time over two years. But that’s okay given that we can share a short closeness with nations we could not possibly have engaged with outside of the Security Council. Then, after two years, everything will go back to the way it was. What then? Money well spent hey?

EU Nobel Prize More of Giggle Than a Full-Bodied Laugh

Have you heard that bit about the European Union? No? It goes a little something like this:

EU walks into Oslo City Hall, takes all the chairs and is awarded the Nobel Peace Prize.

Well, a number of people are viewing the awarding of the Nobel Prize for peace in that manner, a complete and utter joke. But, it’s not quite as farcical as one might think. Does it look good? No, not in particular. It doesn’t really matter what it was given out for, people have made up their own minds about this year’s recipient and their worthiness.

Perhaps the European Union receiving the peace prize was a not so clever ruse perpetrated by the committee, which had the intention of getting people talking about the award again, but that actually backfired?

Let’s begin to put the award in some context. What is the Nobel Peace Prize awarded for? Well, that’s all pretty clear there in italics. It’s about peace, or at least that was the original intention of the honour. The prize has come to mean so much less because the original intent of the this particular Nobel Prize, peace, has not always been behind the gifting of it.

The long-awarded prize has turned into a recognition, not every year, but from time-to-time, of relative peace rather than absolute peace on earth, sleigh-bells jingling and all that jazz.

Again, to the intent of the prize which appears lost on a number of people. It is about peace. The European zone, in case anyone hadn’t noticed, is going through a prolonged period of economic woes. They’re not great money managers, but that is usually a whole different story to being a peaceful or relatively peaceful region. Yes, we have witnessed scenes of less than peaceful protests, but that is slightly different to governments or individuals not promoting a wider form of peace.

Do economic woes sometimes lead to conflict? You bet. But precious few, indeed probably only the most uninformed, are suggesting that scenario carries any legitimate weight.

The Nobel Peace Prize was awarded to Europe for their post-war efforts in developing the region into a peaceful, relatively secure continent after World War 2. It is a recognition of the huge shift from a politically and geographically divided region into one of relative harmony, regardless of the much less than ideal way the continent decided to go about uniting. It is though entirely arguable that awarding a supranational institution, which has the ability to erode national sovereignty, is a stupid one. Again, it seems to hark back to the Nobel committee rewarding relatively peaceful, secure and democratic recipients.

The European Union being given the award is also just as much about the way in which it has promoted human rights. Few could deny that Europe, partly as a result of the shame wrought by World War 2 acts of barbarity and aggression have fostered a culture promoting the human rights of every citizen. The European Court of Human Rights is an example of one such institution which aims to further the cause of human rights across Europe.

Very few doubt the source of black humour that the award has become. In 2009 the award was bestowed upon the President of the United States of America, a world leader responsible for the increase of drone attacks which have killed countless civilians, among other things. Examples of recipients like this are probably playing a part in clouding the judgement of the masses.

The Nobel Peace Prize has been awarded to an institution. It is an example of a body set up with the express purpose of promoting human rights. That’s great, but the award should be limited to individuals, or at the very least small groups of individuals that aim to promote peace, security and human rights, governments and governing bodies should do this as a matter of course.

The 2012 award does not look great, but it’s far less humorous than many are making out. It appears there is a need for a vocabulary lesson in order for the difference between economics and peace to be distinguished.

Attention UNHCR: Not Just Australia That Needs to Do More on Refugees

This morning the United Nations High Commission for Refugees (UNHCR) put out a statement calling on Australia particularly, as well as the international community to assist more in providing humanitarian assistance options to help stop asylum seekers taking “dangerous and exploitative boat journeys”.

The UNHCR, tasked with overseeing the provisions of the United Nations Convention on Refugees made these comments in response to the terrible tragedy overnight where an asylum seeker vessel capsized en route to Australia, with 3 confirmed dead, 110 rescued and approximately 9o people still missing.

This most recent tragedy again emphasises the need, like the refugee agency points out, for countries like Australia to do more and in some cases, at least something to cut down on the need for these desperate people to make the seriously dangerous journey in craft often not much more seaworthy than a large esky.

It is important to recognise that the refugee situation begins long before people reach Australia and while we can and should do more, we cannot be expected to take all of the burden, particularly after refugees who seek asylum by boat have made their journey often through and past other nations before arriving in Australia.

But this is only part of the story and but a part of the solution needed in an attempt to stop asylum seekers from risking their lives trying to find a better, safer life in places like Australia.

The High Commission for Refugees is itself part of the problem with processing though admittedly difficult, in many cases actually being very slow and leading to many refugees being stuck in limbo, whether that be in refugee camps dotted around the world in conflict zones or stuck in limbo in other ways.

The UNHCR do need more resources and time deployed in major conflict zones and countries facing humanitarian crises, but this is only the first step, however it is an undeniable aspect of the refugee situation that cannot be ignored.

It is also true the asylum seeker/refugee conundrum of refugees in camps within and near countries in turmoil is not just down to the slow action of the UNHCR in processing refugee claims.

Countries around the world that have signed the Refugee Convention are obviously too dragging the chain with absorbing the number of refugees currently awaiting relocation and asylum seekers that wish to seek protection in another country. This could be down to many reasons and the cost burdens particularly after the effects of the Global Financial Crisis and the continuing Euro crisis are factors that cannot be denied in the current debate over refugee relocation as far as some nations go.

This does not excuse the chain dragging prior to the financial events that have negatively impacted on economies around the world. There are obviously issues that have meant that prior to the financial events that have devastated countries around the world that as a result countries have not taken up the massive amounts of refugees around the world.

The scale of the refugee problem is massive and borders on the unsolvable at the very least at a political level with, as of 2010 a total of 43.3 million people worldwide who were either identified as refugees, internally displaced people (IDP’s), asylum seekers, returnees or stateless people.

No one government, no series of governments, no agencies, organisations, no one person or people will be able to guarantee that in the future nobody will get onto boats in desperation and head to various countries in the world. That is the sad reality. The potentially deadly situation can only be minimised.

The first part of any reduction to the refugee  problem is that the remaining 50 odd nation states not signatory to the convention should be persuaded to sign on the dotted line, though some of these nations are where the asylum seeker situation begins and others are middle destinations where asylum seekers and genuine refugees can languish for years before making the journey to places like Australia.

Obviously another response to the issue is for nations around the world that are signatories to the convention, but not to the protocol to sign that and enshrine it in their respective domestic law and then make appropriate arrangements in accordance with those provisions too.

Obviously too, many nations could and should increase their intake of refugees and seek to undertake with the UNHCR to help with the massive processing task which stymies the refugee process from the outset and leaves many in desperation within their own countries or in other nations in their region.

These last two points need to include, in particular Malaysia and Indonesia signing and adopting the Refugee Convention provisions and the protocol into their own law because these two nations are often the final stopping point and often the destinations from which asylum seeker vessels embark on the perilous journey towards Australia.

Other countries in our region that are signatories to the Refugee Convention and its protocol must also increase their share of the processing of asylum seekers and refugees and we must continue to work harder under the Bali Process as a region to deal with the movement of people who have found themselves in dire circumstances.

Another ingredient in the global recipe to cut down on the deaths of asylum seekers is for nations to truly tackle people smuggling. But this alas is made all the more complicated by the immense coastlines of the nations from where refugees come to Australia. It is also made difficult because of levels of police corruption  and complicity in the criminal act which have been found to exist in the region when it comes to the asylum seeker trade plied by these individuals and groups.

The final part of the puzzle is that Australia must increase our intake of refugees, at least by a similar extent to the increase we would have taken in under the so-called ‘Malaysian Solution’. This simply has to be seen as a reality if we really view people drowning at sea as a problem and we should.

The problem is not just an Australian one and becomes a bigger situation for Australia to deal with once refugees and asylum seekers reach our region and that needs to be recognised by other nations and the UNHCR before implying Australia above others particularly in our region needs to bear responsibility for stopping people getting on boats and coming here. Other nations in our region simply go close to ignoring the asylum seeker plight and the people smuggling that comes with it altogether.

Sadly, the scale of the task that is dealing with refugees in a fast, efficient and orderly way is astronomical and the process time consuming with the sheer numbers already seemingly well beyond reach of being able to deal with. However, we have to as a nation, a region and as an international community all try to minimise the risks of asylum seekers dying at sea.

Joel Fitzgibbon Has it Almost Right on Afghanistan

One time Defence Minister and now Chief Government Whip, Joel Fitzgibbon today uttered the awkward but necessary reality that some Australian troops, probably special forces, may and should remain in Afghanistan well after the already stated withdrawl date of 2014. These comments come less than a day after Taliban militants struck urban areas across Afghanistan, including the capital Kabul, attacking government buildings and diplomatic missions as well as a NATO facility.

The government have already stated that the majority of Australian troops will be coming home within the next two years, but that there is a real possibility that elite soldiers may remain well after the planned withdrawal date.

Mr Fitzgibbon, on his return from visiting the NATO headquarters in Brussels, stated that the attacks which were quelled today after more than half a day of fighting proved that “the peace in Afghanistan is at best a fragile one”. This is very true, whilst the attacks  in the major urban cities of Afghanistan have been rare in recent years, aside from a similar one last year, the fact that they are still occurring and not being smothered, or even discovered beforehand is a cause for major concern regarding the real level of readiness of Afghan security services post combat troop withdrawal.

At the outset it is important to note that the ongoing effort in Afghanistan will be one more of harm minimisation as opposed to the ideal outcome of crushing Al Qaeda and the Taliban.

The events over the last 24 hours or so provide some evidence that a greater level return of troops to the major cities is a necessity both to train and supplement Afghan police and army stationed in these cities.

The attacks also point to the need for greater border security, particularly around the Afghanistan-Pakistan border areas where, in the worst kept secret of the conflict, many Taliban fighters are known to have fled and to have even been welcomed by elements of the military and intelligence community in the neighbouring country.

Greater intelligence efforts of both the Afghan and international community need to be deployed into these border regions to help identify, prosecute or eliminate border crossings by known Taliban fighters and this kind of intelligence building and effort cannot occur overnight as many members of the Taliban may just wait out international forces before returning to the country when it is safer for them to do so. In the case of intelligence cooperation, an ongoing cooperation between Afghanistan and particularly US intelligence services is a necessity.

Where Fitzgibbon starts going wrong is suggesting that, in his view the mentoring task force would have returned home by the end of 2014, like the artificial timetable created suggests. If any part of the Australian commitment had to remain in Afghanistan post 2014, it predominantly should be those tasked with mentoring the Afghan National Army and police. It is the security forces that we as a nation have been partially responsible for mentoring that weren’t ready yesterday wasn’t it?

It is certain that the security situation in Afghanistan is tense and that the threat of combatants returning from Pakistan through the porous borders is a certainty, regardless of the timing of an exit and needs to be responded to with continued security and intelligence cooperation between nations. The question is, will a war weary and debt-ridden international community be able to stomach continued commitment to peace and security in Afghanistan? Equally so, will the Afghan Government, increasingly weary of the international presence and occasional misadventure be happy for this to continue to occur? That is far from definite.
