Pretending Not to Fail at Asylum Seeker Policy
Prime Minister Julia Gillard spent some time with our friends across the Tasman over the weekend. The Prime Minister met with her New Zealand counterpart John Key in Queenstown for the annual Australia-New Zealand Leaders’ meeting. Among other things, the meeting triggered a warning to phone companies to bring down roaming charges or face regulations and also a $3 million pledge to try to develop a vaccine for rheumatic fever.
But it is the asylum seeker and refugee conundrum which will always garner the most attention in the media and tend to dominate talks with other nations in our region. And of course this trip was no exception.
Both the Australian and New Zealand Prime Ministers’ managed to reach a new deal with regard to refugees. It was agreed between the two leaders that New Zealand will accept and resettle 150 refugees from Australia. The agreement, commencing in January 2014 will see the transfer of genuine refugees from the Australian mainland and also the offshore immigration facilities on Nauru and Manus Island.
On the face of it, the deal looks pretty ordinary, but at least like an attempt to deal with the movement of asylum seekers in the region. But it is not even close to a deal that understands the policy problem facing governments in the Asia-Pacific.
The deal fails in two key areas. First, it is an attempt to appear to be trying to do something in terms of the domestic policy situation surrounding refugee policy which is a fraught area for government. Second, it appears to be an attempt to deal with the regional nature of the asylum seeker equation which is a traditionally much more difficult part of the “solution” to reach agreement on.
Australia agreeing to send 150 refugees to New Zealand gives the appearance of acting on the domestic implications of irregular people movements. But in reality the deal will do nothing of the sort. It will not cut down the overcrowding of detention centres in Australia and our offshore facilities. The number, 150, is simply too low for that aim to ever be achieved.
Voters will know that it is the performance of a political illusion. It is an attempt to appeal to the irrational fear of outsiders that a number of our politicians seem all too willing to gently prompt with their often deliberate choice of language when describing maritime arrivals. Politicians care far too much about the votes in being tough on asylum seekers. In fact they should not be tough at all – there is no crime involved, so no punishment is required.
The pact reached at the weekend also fails the regional test. The deal, involving the transfer of genuine refugees from Australia to New Zealand is given the veneer of a regional solution, but it is nothing of the sort. In fact, the only thing remotely regional about the policy is that it involves more than one country in our region.
With the deal there will be no increase in the number of genuine refugees that New Zealand takes in on an annual basis. The 150 refugees that New Zealand will accept from 2014 will be a part of their annual intake of 750. That adds nothing to the regional quota and will still see a large number of boats arriving in Australia.
A significant addition to the refugee intake in the region is what is needed. And with a number of countries in Asia not signatories to the Refugee Convention, it is discussion to get those countries onboard, and a deal with New Zealand on a quota increase which is required to do anything significant about people movement in the region. Of course Australia has recently decided to increase its humanitarian quota, but the election result will likely see it return to the previous number.
But the regional part of the policy discussion is not the only important and meaningful part of the puzzle. Even those politicians with a keen interest in the regional dynamics of the discussion are missing the point. Far too often the regional options are discussed at the expense of the international. Refugee policy is an international problem because conflict is an international problem across all regions of the world.
The agreement contains two false attempts at pursuing refugee policy in a meaningful way, both domestically and regionally. Couple that with an international failure to acknowledge and deal with the movement of people in the early stages and you can be sure we will continue to see large numbers of asylum seekers making the dangerous journey to Australia by sea.
The Tale of Thomson and the Two Questions
The allegations surrounding Craig Thomson have never been far from the headlines. In fact the Thomson saga has been one of the most constant topics raised during the 43rd parliament. Today, the long-running investigation took a dramatic turn, as we all know, with the Member for Dobell arrested by New South Wales police on 149 charges of alleged fraud. The former Labor MP was arrested at the request of Victorian police and was today bailed before being required to appear next week in the Melbourne Magistrates Court.
Of course today’s events triggered a flurry of discussion about just what the arrest and charges will mean, not just for Craig Thomson himself, but for the Labor Party, the parliament and the election. Much of this debate has played out in the past, particularly after the Fair Work Australia report was released and when the police investigations commenced. But it does seem that some of us have forgotten the state of play.
First and foremost it is extremely important to reiterate that today the NSW MP was charged, and, like every Australian, is entitled to be subject to due process. That means that the Member for Dobell is innocent until proven guilty, regardless of what our personal opinions and political predilections are.
There were two common questions being asked today as the debate ensued after Thomson’s arrest. The first was: ‘what will this mean for Labor now and in terms of the election?’ The second questions was ‘hmm, is it just a coincidence that Julia Gillard called an election yesterday and now, today Craig Thomson is facing criminal charges?’.
The answer to the first question remains exactly the same as it was when it was first raised as the investigations into the matter began. The Australian Constitution has this to say in s44 (ii):
“Any person who –
(ii.) Is attainted of treason, or has been convicted and is under sentence, or subject to be sentenced, for any offence punishable under the law of the Commonwealth or of a State by imprisonment for one year or longer…
shall be incapable of being chosen or of sitting as a senator or a member of the House of Representatives.”
So that makes things pretty clear for those who have missed the point again today. A conviction needs to be recorded against Craig Thomson first before his parliamentary future is affected in any way. Further, the offence has to be punishable by imprisonment for one year or more. Well, there is no problem with the latter if the MP is convicted.
In terms of the election, Craig Thomson’s arrest is likely to mean absolutely nothing except, as you would imagine, certain electoral defeat. It is extremely unlikely that any trial involving the now Independent MP will be concluded before the 2013 election which we now know will take place on September 14th. The only way it would be possible for action to be required under the provisions of s44 is if Mr Thomson were to plead guilty and he has already indicated that will not happen.
In terms of the election and Labor’s prospects, even the charges alone will surely prove to be yet another nail in the electoral coffin for Labor. They will add to the narrative, already well constructed, of distrust.
Above all, Labor will survive until the election.
The second question is an interesting one. It posits that the Prime Minister knew of the impending arrest of Craig Thomson and therefore decided it would be best to call an election.
It is entirely possible that the Prime Minister knew that Craig Thomson was going to be arrested. The media were indeed tipped off so it is understandable to question whether or not the PM was aware of the imminent charges against Craig Thomson. Julia Gillard denies that she was made aware of the arrest before it happened.
Even if Prime Minister Gillard was aware that charges were about to be laid against Mr Thomson, and then decided to call an election as the conspiracy theory posits, one simple fact remains – there is absolutely no benefit, political or otherwise, to be gained from the PM calling an election early because of the Craig Thomson matter.
The charges are a sensational development, but frankly, almost nothing changes.
Myths and Realities About the 2013 Election
Today at the National Press Club the Prime Minister revealed something quite surprising and very rare in Australian politics. An election has now been called – well unofficially, but official. Not since Sir Robert Menzies was Prime Minister has an election been called so early. In fact today Julia Gillard broke Menzies’ record. Robert Menzies, on three separate occasions, informed the voting public of his intention to have an election in 3 months time. Today Prime Minister Gillard bettered that mark by more than double the time.
We can now look forward, or perhaps not, to an election on Saturday September the 14th after the longest campaign in Australian political history. In 225 days we will know the exact results of the 2013 election, seat by seat.
Out of the announcement today and the ensuing robust and at times acrimonious discussion, particularly on social media, arose multiple myths which need busting. False assertions were made. Of course, you are saying ‘well that’s politics’, but the realities of the political situation are what they are underneath all the spin.
The first myth is one perpetrated by the Prime Minister. In making the unexpected announcement of the 2013 election date, the PM asserted that it was not to kick off the world’s longest election campaign.
The Prime Minister is right in a sense. Julia Gillard has not kicked off the world’s longest election campaign with her announcement today. The campaign effectively began way back in 2010 after Australian’s almost handed government to the Coalition. It has already been the world’s longest election campaign and we now have almost eight more months of it before the big day arrives.
But the Prime Minister is also very wrong in her assertion. Now that there is an election date, the campaigning will just continue to accelerate and become an even more regular part of our daily existence. Politicians will increasingly crisscross the country and seek out as much media attention as possible in the coming months.
The second myth was again brought to us by Julia Gillard. The PM contends that now the unofficial campaign which she did not want to commence has indeed begun, the opposition will now have to begin submitting their policies for costing. Ms Gillard could not be more hypocritical in this assertion.
The reality is that all oppositions, regardless of political hue will often delay submitting and revealing their costings for as long as possible. This is both a political move and a sensible policy move. The budget is an ever-changing and challenging beast, so political parties in opposition need to adapt their political priorities to deal with fiscal realities. In any case, to submit a wide array of budget items for review so far out from an election is, to be frank, unheard of.
Today a few MP’s have pointed out that the election day will fall on Yom Kippur, the holiest day of the Jewish calendar. And they are not particularly happy with Julia Gillard for choosing the holy day for the 2013 election.
It is a myth that this will drive down the Jewish vote. Everybody has to attend a polling booth. People have been able to vote before election day in the past and will be able to again this year. And funnily enough, pre-poll queues are actually significantly shorter than those you can expect on election day. To top it all off, senior Jewish officials have today said that there will not be an issue with Ms Gillard’s choice of election date.
The situation does however get a bit tricky for Jewish MP’s and there has been a mixed reaction, with Michael Danby issuing a statement saying that in accordance with his faith, he could not take part in election day activities. Effectively this rules out a day on the hustings greeting voters at polling places. However, it is unlikely to make a difference to the vote of any member of parliament if they happened to not be visible on polling day.
Fans of football have raised similar concerns with the choice of election day. Preliminary finals will be on, both in the afternoon and evening. Suck it up football fans. You can vote early if you are concerned that you might miss out on attending your precious game of football because you are performing a much more important duty.
So there you have it, some election myths busted and realities revealed.
The path to the 2013 election has already been a long one, but now we know when it will all end.
It’s Not All Bad Mr Mathieson
Australia’s first man told a joke today and it did not go down at all well. Prime Minister Julia Gillard’s partner, Tim Mathieson was speaking at a function welcoming the West Indian cricket team to Canberra, the topic: prostate cancer. You could just how rapidly the Prime Minister’s facial expression changed. Very quickly Ms Gillard’s expression shifted from a wide smile and a twinkle in her eye to a look of ‘oh my this is going to create headlines’.
The so-called joke, went a little like this:
“Get a blood test for it. But the digital examination is the only true way to have, to get a correct reading on your prostate so make sure you go and do that and perhaps look for a small, female Asian doctor is probably the best”
What Mr Mathieson said was wrong on a few levels, but it is entirely possible that his ill-conceived joke may have drawn more attention to prostate cancer than if the speech had just reached its Canberra audience. At least in some oblique way, the topic of prostate cancer prevention has been aired in the general community. Perhaps the joke might have even made some men feel more at ease with the whole process and could lead to them having their prostate checked at the recommended intervals.
What was completely right about the short quip from the first bloke was telling the audience, and now Australia, just how easy the testing process can be. We all knew that a prostate examination is important, but perhaps fewer people would have been aware that there is a blood test for the cancer, though of course doctors already know that. But some men probably do not.
There are three elements of the gag which were wrong and completely unnecessary.
The first being the use of a stereotype: that women, particularly Asian women, are small. Not entirely untrue, but a needless generalisation.
The second unfortunate element of his public service message was the unnecessary reference to a particular gender: women. Male doctors can and do give prostate examinations if you are comfortable with that.
Finally, the gaffe would almost certainly fit into the category of casual racism. There was no need to single out a particular group of people. There are small people in all races.
What the Prime Minister’s partner should have said was something like this:
“Get a blood test for it. But the digital examination is the only true way to get a correct reading on the health of your prostate. So make sure you go and do that and perhaps look for a doctor with smaller hands, because it might feel a little uncomfortable”
There you have it, a non-racist, non-sexist gag without any silly generalisations. Hey, the little joke at the end would have probably made the PM laugh a little.
Today’s blunder should serve as a reminder of the need for the spouse of our nation’s leader, whomever it may be in the future, to be a little more dignified in the way they approach speaking in public. Australia’s reaction was probably rather muted to what would have happened if the same tasteless and tactless verse was used elsewhere in the world.
But hey, if it got the message across then it’s not all bad.
Doing a Good Thing in a Terrible Way
We all know it’s an election year. With an election year comes the introduction of some key candidates in the media. And don’t we know it after yesterday’s events. Yesterday we learned that the Prime Minister plans to ask the national executive of the Australian Labor Party to endorse sports star and proud indigenous Australian Nova Peris, for the Labor Senate ticket in the Northern Territory. The trouble is, the process wasn’t exactly clean, and the internal ructions in the Labor Party have again been given more than a bit of a nudge.
It emerged today that the Prime Minister last night asked Senator Trish Crossin, a fifteen year veteran of the Senate for the Labor Party, to stand aside for Nova Peris. And as you would expect, Senator Crossin is not the slightest bit at ease with the merciless decision. The Senator made those feelings clear too, in both a written statement and on camera.
There are many things that can be said about the decision taken by the Prime Minister. But first and foremost is that the move was handled abysmally by a Prime Minister who should know better, though Julia Gillard herself was a player in the unceremonious dumping of a sitting MP – a Prime Minister no less – so perhaps we should not be surprised.
At the same time though, in general, we should not be surprised. It is politics after all and reasonable processes are often shirked and politics played with the pre-selection of candidates. But this does not make this brain snap at all forgivable. How can we not continue to remain cynical about politics when such unsavoury acts continue to happen in politics?
But let’s get positive for a moment – just a moment. And only half positive. The idea to increase indigenous representation in politics is a good one. If this move succeeds, Nova Peris will become the first indigenous representative in the parliament from the ALP. The trouble is that the Prime Minister has still trodden all over a long-time servant of Labor.
Ms Gillard had a real opportunity after the February leadership spill last year to appoint the ALP’s first ever indigenous parliamentarian, Warren Mundine, under much better circumstances after machine man and apparatchik Senator Mark Arbib resigned from the parliament. Instead she chose a political has-been.
There has been speculation that the move may have been in some way, retribution for Senator Crossin’s forthright support of Kevin Rudd in terms of the Labor leadership. That argument is certainly not without foundation. One only needs to look at the way the careers of both Robert McClelland and Kim Carr, both ministers at one time, have suffered after being very public friends of Kevin Rudd.
But it’s also possible that it’s just a very badly thought out plot from the Prime Minister. Again, there’s a history there. So we could quite easily put this sorry excuse for process down to bad judgement.
Senator Crossin has made no bones about her intention to fight the move as hard as she can. But can she beat the machine?
There will be a ballot after nominations close on the 28th of January and Senator Crossin will nominate for that poll. But the National Executive of the ALP, who today approved Nova Peris’ membership of the party, will be the group that decides the outcome of this ugly affair and not the Northern Territory branch.
In the meantime, the spectacle will not become any more gratifying. The sniping will continue and the political benefits of the lack of internal cohesion in the Labor Party will continue to flow the way of the Coalition. The Coalition too will also be able to use this further example of internal division as prime election material.
If there is one key thing that can be taken from this whole mess, it is that Nova Peris was ‘selected’ as part of a dodgy process. And that is all that most people have talked about in the debate that ensued.
The actions of the Prime Minister have resulted in the Labor Party receiving a very public political drubbing. The vocalised discontent does not help paint a pretty picture of Labor in an election year.
The Latest Ruddvention
‘Ruddvention’- a word to describe the all-too-common intervention of Kevin Rudd in matters of national and/or international importance. These dalliances with the media, above and beyond those of any other lowly backbench MP, have taken place a number of times since the former Prime Minister was deposed. And the latest display of self-important politicking, surprise surprise, takes place just after Prime Minister Julia Gillard reached a rather uncomfortable milestone, perhaps for both of them- the same amount of time in office as former PM Rudd.
At least this time Mr Rudd picked an area of policy close to his heart and that is foreign affairs. The former PM and one-time Minister for Foreign Affairs today released a statement on the Syrian conflict, now two years old. Rudd believes now that the Syrian rebels must be armed in order to bring a more swift end to the internal conflict which has seen approximately 60,000 die.
The problem with Kevin Rudd coming out and pleading with everyone to realise just how smart he, in his mind believes he is happens to be two-fold. There is the policy-based disagreement with the official Labor line on Syria and then there is the distraction that it provides and the cannon-fodder it gives the Coalition, as if they were in need of any more election year ammunition. In the scheme of things both effects are minor. But the point is that in an election year, both impacts are unnecessary from someone who should release he needs to further the Labor cause, not his own selfish interests.
In terms of the policy itself, former PM and Foreign Minister Rudd, as stated earlier, believes that the Syrian opposition forces must be armed. Kevin Rudd has pointed out, quite rightly, that the situation in Syria is already far beyond a humanitarian crisis. The Assad regime has clearly perpetrated crimes against humanity, mind you, opponents of his regime appear to have engaged in much the same brutish and barbaric, downright inhumane behaviour too. This position is very similar to the viewpoint he pushed in the international community regarding the civil war in Libya, while Minister for Foreign Affairs
It is here where his position and the government’s are at loggerheads. With the UN Security Council unable to reach an agreement on any meaningful action, and with Australia no longer willing to get so involved in a far-off internecine battle- the Gillard Government, along with the rest of the world, is continuing to try to tread carefully yet meaningfully down the diplomatic pathway. Senator Bob Carr and the government want both the Syrian Government and the opposition to talk to each other. They want, in a case of vain hope, some kind of amicable end to the scenes of chaos and devastation.
This latest disagreement between Rudd and his party, though slight in the scheme of politics, will add to the library of election material that the Liberal Party has surely amassed over the past two-and-a-half years. Added to the litany of examples, it all amounts to a story of internal division. It’s the kind of thing the Labor Party do not need in an election year. Labor do not need distractions. The ALP need discipline and at least an air of togetherness and harmony, whatever the real story within the caucus.
It might be lucky for Labor that the latest Rudd flirtation with the media has occurred at the start of the year. All but the most politically attuned are paying attention to the political discourse at present. However, the story has already been written on the Rudd problem and any future Ruddvention, like that today, can easily be added to the election 2013 plot, no matter how insignificant. Any undisciplined and self-serving plea for media attention after the middle of the year would be a big problem.
What to Look Forward to in Australian Politics This Year
Okay, so for some the title of this post will perhaps be a bit of a misnomer. There will be some that are really looking forward to what 2013 means in terms of Australian politics, and there will be others that have greeted the start of 2013 with a sense of dread. Regardless, it’s going to be an epic year on the frontline of the political battle, with the coming months a winner takes all period in politics.
So why will some think of politics in 2013 with a sense of foreboding, and others with a feeling of political glee? In short, it’s because of an event, an 8 letter word starting with ‘e’. Give up? Of course you don’t. You’re thinking, well duh, he’s clearly talking about the federal election. And you would be 100% correct.
Coalition supporters and those swinging voters that have long switched off Labor are itching to have their say at the ballot box. On the other side, you have some Labor supporters that think the job can still be done, who are relishing the contest. Then you have others who feel the election is lost- and it almost certainly is.
The election year will bring something that was conspicuously absent in 2012 and that is serious policy announcements and refinement of existing policies. The politics of personality will still be played and pursued with the same level of vim and vigour as it was last year, but at least there will be a much more positive side to the political discourse as the election- likely sometime from August, approaches.
But with the good of an election year also comes the not so good. Promises will be made and most kept. However, some will inevitably be broken. In years gone by, we had ‘core’ and ‘non-core’ promises, but this has been replaced. We still have policies readily announced, to be implemented as soon as possible, but now in the political lexicon we have a little something called ‘aspirational’ policies. The latter are policies that are usually big commitments and worth implementing, but because of fiscal concerns will be flagged as something for the future. But like non-core promises, surely some will never, ever be introduced.
This election year, do not expect big-spending promises- well, at least not new ones anyway. Expect the Opposition, as they have since the early days of the Labor Government, to spend a significant amount of time focusing on the budget position. According to the polls, good economic management is something strongly associated with the right side of the political spectrum, so why wouldn’t the Coalition take every chance to prosecute this?
Election years also bring carefully targeted spending commitments from governments struggling to maintain their grasp on power and that will not be any different, despite the poll result appearing to be a fait accompli.
Aside from the budget, expect taxation, chiefly the carbon price and the Minerals Resource Rent Tax, to continue to be a major feature in the political to-and-fro. According to the polls, the former is becoming less of an issue for the government, though still it still at this stage presents a problem.
Budget and taxation aside, the election campaign, which feels like it has already been going for some time will largely be a case of both sides of the spectrum trying to position themselves as stable and able to provide effective government.
Like any given year, whether there is an election pending or not, parliamentary sessions take place. Expect the commonwealth parliament to be a slightly different beast, but not altogether foreign to those of us who observed parliamentary politics in 2012. Undoubtedly there will be much more substance in the parliamentary debate this year, but the same noise and antics will be an ever-present feature, with the theatre that is parliament convening for the first time this year in early February. But of course, the election is all that just about anyone in the general public cares about.
It’s only early January and things are yet to heat up, apart from the weather. But do not let the relative silence fool you, because 2013 is set to be one frenetic year. The election is the event to look forward to this year. Then again, maybe not.
More Misguided Industry Policy
The Gillard Government has announced another plan that, in their oodles of wisdom, they believe will perform some truly heroic feats in terms of saving the ailing Australian manufacturing sector.
Prime Minister Julia Gillard, on a visit to OneSteel yesterday, announced that her government would set up an anti-dumping commission to police the dumping of imported goods in Australia which are sold at below cost price. The Prime Minister also announced a doubling of the Customs’ Anti-Dumping squad as part of the plan.
To fund the plan, Australian Customs will receive extra funding of about $24.4 million over four years which will be directed towards furthering the aims of the commission and its investigators.
This plan comes after the Coalition’s announcement in November last year that they would establish a body to investigate anti-dumping if they were occupying the government benches.
According to the Australian Customs and Border Protection Service’ Anti-Dumping website dumping “occurs when goods are exported to Australia at a price that is below the ‘normal value’ of the goods. The website defines the ‘normal value’ of goods as “the domestic price of the goods in the country of export.”
The Customs website acknowledges that dumping is not illegal under international trade agreements, but that “remedial action may be taken where dumping causes (or threatens to cause) material injury to an Australian industry.”
There are a few observations to be made about both the announcement by Prime Minister Gillard and dumping itself.
The first is about the increased bureaucracy as a result of the plan. How a larger public service will substantially resolve what is termed as a problem for Australian industry is uncertain. By virtue of the fact that dumping is not illegal under international trade agreements, surely resolving the vast majority of cases in a positive way for Australian businesses will be a near impossible outcome.
What’s even more sad is that both sides of politics agree that a response needs to be initiated. Both sides of politics want the same kind of action in this area. They both think the same action will provide some significant relief to industry. Of course, industry groups think this will happen too.
Both sides of politics are living in a policy fantasy land akin to being on some kind of LSD trip.
Australian manufacturing, even if regularly successful in prosecuting anti-dumping cases, will still be at a distinct disadvantage compared with Asian companies when it comes to producing and selling cheap goods on a large-scale. Our inputs costs will always be higher than in Asian countries and therefore, so will the costs of our manufactured goods.
Next, why doesn’t someone in government think of the consumers?
Would it not be absolutely fantastic if we could receive even cheaper goods, especially when cost-of-living pressures are impacting on consumers in our domestic marketplace?
Many people have already shifted to online shopping through overseas businesses because of their ability to offer cheaper products than we could ever hope to have offered to us domestically and good on them for doing so. If ever there was an example of consumers being rational, then the decision to shirk Australian businesses is a positive example thereof.
Of course, the response, endorsed by both sides of politics is designed to appear as if they are doing something to support industry. And industry groups actually think the move will help them survive
The reality however, is that there is little that they can, or would be prepared to do in order to really protect what are largely uncompetitive industries in global terms.
Whatever happened to focusing on the things that we are good at as a nation? The areas of the economy where we can actually compete with the world and where we have a competitive advantage.
Hawke-Like in Appearance But Not in Reality
Last week the Business Council of Australia called for it and today Prime Minister Julia Gillard reached out and offered it. Today the Gillard Government wrote to the Business Council of Australia and the Australian Council of Trade Unions offering what at first glance has the appearance of an olive branch to the business community from the Labor Government. The Prime Minister has now sought to give business, the unions and community groups the chance to participate in a national forum, to be named the National Economic Reform Panel.
The proposal from the Prime Minister is an attempt to get business onside, or at least to get them in closer proximity to the unions on a more regular basis than is currently the case. At present, aside from issue-specific working groups and committees, the relationship is limited to largely informal communications between the two interest groups.
The idea of the National Economic Reform Panel is said to be in the spirit of the Hawke Government Accords which saw unions make concessions in order to benefit from other policy changes.
The reality is more than likely going to be quite different. The only likely similarity is the make-up of the panel. They may agree from time-to-time in certain areas but overall, little compromise, except perhaps on taxation, is likely to be achieved.
The idea that the Gillard Government, through this panel, can achieve trade-offs similar to the ones that characterised the agreements which Bob Hawke’s government reached is just fanciful. Prime Minister Hawke’s agreements between business and the union movement were much deeper and broader than any Julia Gillard and her government may achieve, both in theory and practice.
An important part of negotiating is that nothing, within reason, be left off the table from the outset. However, it appears that changes in certain areas of law, specifically industrial relations, will not be on the table from the outset. That’s all fixed according to the government.
Of course, the unions are unlikely to budge on industrial relations in any case, unless it results in significant new power for their side of the bargaining table. But law changes that do not impact negatively on wages and conditions for employees must have a place at the meetings of this tripartite group.
It would appear likely that most of the changes that the panel would find itself agreeing to would just tinker around the edges of existing policy. Some existing rules and regulations and government policy would undoubtedly remain untouched as a result of negotiations between the three parties. So then unilateral government action would be required from time-to-time, defeating the purpose of such a panel.
Instead of being more like the accords under Hawke’s Labor Party, it appears, according to the letter that talks between business, the unions and community groups will have a central focus around how to implement the key recommendations of the Australia in the Asian Century White Paper. To this end, the idea of the panel is, in a way, more issue-specific again than about the broader economic challenges in the future which involves much more than just looking to Asia and thinking about how it is we can best compete in our region, the Asia-Pacific.
While the Asian Century White Paper does allude to domestic decisions that need to be made and implemented to compete with Asia in the Asian region, some of these are quite Asia-specific and we cannot spend too much time as a nation focusing on one geographical area. Other areas of the world that we engage with have a diverse range of needs quite independent to that of the Asia-Pacific and Indo-Pacific regions.
The timing of the announcement and what that implies suggests that the broader intent of the negotiating platform flagged by the Prime Minister has come too late, despite the fact that the BCA boss called for the panel as recently as last week.
The announcement of the reform group comes over two years into the second term of the Rudd-Gillard Government. Many of the key reform decisions have already left the parliament having been made into law. Some of these economic changes have had more business input than others, some with quite limited formal and direct negotiation with peak business bodies and company representatives.
Another certainty is that just about any agreed action in the near future faces the likely prospect of not being implemented. The budget is in a poor position and appears as though it will get worse before it gets better. So, in effect, business, the unions and community groups would be working towards having the government acknowledge aspirations in the near future at least, rather than implementing dramatic actions.
A nice symbol that gives the false impression of cooperation and a willingness to negotiate, but the reality underlying today’s decision is something almost completely different.
Perhaps it would have been better if the call to formal and ongoing discussions from the government had not come after five years of aggression towards certain areas of the business community from the same administration.
The likely outcome of discussions however, would probably be much the same.
